Application of the General Terms and Conditions

These conditions govern the sale of products presented on this site (mesdessous.fr) by SARL ESPRIT GRENADINE.

These terms of sale may be modified at any time without notice. Any order implies full and unreserved acceptance of these general terms and conditions of sale. The parties agree that the contract formed by these terms of sale is subject to French law.

These general conditions express the entirety of the obligations of the parties. In this sense, the consumer is deemed to accept without reservation all the provisions provided for in these general conditions. No general or specific condition appearing in the documents sent or delivered by the consumer may be integrated into these conditions, should these documents be incompatible with these general conditions.

Validity of Offers

The items offered on the mesdessous.fr site are available until suppliers' stocks are exhausted. mesdessous.fr does not guarantee in any way the maintenance of products for sale over a given period.

In the event of payment for an order of an unavailable item, mesdessous.fr undertakes to refund the Customer within 15 days. Any order for an unavailable item will be the subject of an email from mesdessous.fr.

Product Prices

Prices, order summaries, and billing are carried out in euros or in the currency linked to the customer's billing address. Prices are presented in euros all taxes included (VAT) for European Union countries. The consumer has the possibility to choose the display of prices in other currencies such as the US dollar, the pound sterling, or the Swiss franc.

The VAT amount is indicated when a product is selected by the Customer. In the event of a change in the VAT rate, this would be reflected in the prices without the customer being informed in advance.

For deliveries outside the European Union, prices are displayed excluding taxes. The collection of the tax is made upon delivery according to the procedures in force in each country. mesdessous.fr reserves the right to modify its prices at any time. Products are billed at the prices displayed on the mesdessous.fr site based on the rates in effect at the time the order is registered.

Product Presentation

The description of the products offered for sale on the mesdessous.fr site is made with the greatest care, with photographs owned by the brands illustrating the products in support of the text.

Order and Payment

Payment

The customer validates their order as described below. This validation implies acceptance of these general terms and conditions of sale. Any order will only be considered after acceptance of payment.

During their first order, the customer fills out a form containing the following details: title, last name, first name, full delivery address, email, phone number, and date of birth. This is when the customer creates their password.

The customer wishing to purchase an item described on the mesdessous.fr site follows the process below to set up their order. After clicking the "confirm" icon and verifying the specifics of their order (color, quantity, size, price, etc.), the customer validates the choice of the selected product(s) with a click.

If the customer benefits from a special offer, they must first enter a code assigned to them in the field provided for this purpose.

The customer has the option to pay by credit card or PayPal directly on the site, or by check.

After validating their payment method, the customer definitively and irrevocably validates their order with the elements indicated below.

Order Confirmation

After recording the order, an order confirmation will be sent to you by e-mail. If you do not receive an e-mail within an hour of your order, it is recommended that you contact customer service at serviceclients@mesdessous.fr, to verify that there was no problem in the ordering process.

Payment Security

To ensure payment security, the mesdessous.fr site uses the secure payment service of the CRÉDIT AGRICOLE bank. This service integrates the SSL security standard. Confidential data (the 16-digit credit card number as well as the expiration date, the CVX code) are directly transmitted encrypted to the bank's server without passing through the physical media of the server used by mesdessous.fr.

When the order is validated:

• The payment request is routed in real-time to the secure telepayment manager.
• It sends an authorization request to the credit card network.
• The telepayment manager issues an electronic certificate which will serve as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 and following of the civil code.

Verification of Payments

mesdessous.fr controls all orders that have been validated on its site to protect itself from abusive practices by fraudsters.

Our customer service may ask you for documents necessary to unblock your order. These requests are made for new customers or for orders over 150 Euros. No order will be validated if the customer already has pending orders for an amount greater than 300 euros.

Identification

A Customer who has already placed an order on the mesdessous.fr site can choose a password that will allow them, during subsequent orders, not to have to fill out the forms essential for placing the order.

The already registered Customer is recognized on the site as a customer of mesdessous.fr.

The mesdessous.fr customer's password is personal and strictly confidential. It must remain secret and cannot be communicated. If the customer forgets or has forgotten their password, they must notify mesdessous.fr customer service as soon as possible. A new password will be sent to them within 72 hours and will replace the old one.

In order to facilitate the Customer's identification through the simultaneous provision of the e-mail address and password, the Customer expressly authorizes mesdessous.fr to place on the customer's hard drive a file called a "cookie" whose sole purpose is to facilitate identification.

Default of Payment

mesdessous.fr reserves the right to refuse to make a delivery or to validate an order from a customer who has not fully or partially settled a previous order or who is in a payment dispute.

Delivery

Have your packages delivered wherever you want. For fast delivery anywhere in France but also abroad, we have chosen Colissimo from the La Poste group. Our customers can track the journey of their package via the Internet.

Delivery costs outside Metropolitan France

Delivery is carried out with our partner La POSTE in the form of Coliposte or Colissimo.

Delivery Times

For orders whose products are in stock, packages are shipped within 3 days following the recording of the order (except weekends and public holidays).

• Products in stock: Delivery within 72h (France), approximately 10 days (International).
• Products on backorder: Average delay of 12 days (France), up to 25 days (International).

Customs Taxes

The Customer acknowledges being fully aware of the legislation in force in their country before ordering on mesdessous.fr. Customs or import taxes may be required depending on the country. These taxes are the responsibility of the Customer and fall under their entire responsibility both in terms of declarations and payments to the competent authorities and/or organizations of their country.

Satisfied or Refunded

All items purchased on mesdessous.fr may be subject to exchange or refund. Only items that have not been worn and are undamaged, still labeled and in their original packaging (box, pouch, etc.) will be taken back. For items sold in sets, only the complete set can be returned for exchange or refund.

The period during which the Customer can request an exchange or exercise their right of withdrawal is 30 days from the date of receipt of the item(s). The return of the ordered item(s) must strictly be accompanied by a copy of the relevant invoice. Returns are entirely at the Customer's expense. Write to mesdessous.fr Customer Service to notify them of your return.

Any damaged item that has not been the subject of explicit remarks or reservations by email from the Customer upon delivery will be refused by mesdessous.fr.

It is highly recommended to keep the receipt provided by La Poste. mesdessous.fr declines all responsibility in the event of loss or damage during the transport of the package.

Processing of Undelivered Packages by LA POSTE

These are packages that have not been handed over to the final recipient for the following reasons: NPAI (Not at this address), unclaimed, refused, transport damage, spoliation, etc.

Upon receipt and acceptance of your package by our services, mesdessous.fr will contact the Customer to either resend their order or proceed with a refund according to the Customer's wishes.

Liability

mesdessous.fr has an obligation of means in all access elements to the mesdessous.fr site. Consequently, the liability of mesdessous.fr cannot be invoked for any inconveniences or damages resulting from the use of the Internet network and external to the precautions taken by mesdessous.fr.

Intellectual Property

All visual or audio elements, including the underlying technology of the mesdessous.fr site, are protected by copyright, trademarks, or patents. They are the exclusive property of mesdessous.fr or partner brands.

Any hypertext link redirecting to the mesdessous.fr site and using notably framing, deep-linking, in-line linking or any other deep-linking technique is strictly prohibited.

In all cases, any link, even tacitly authorized, must be removed upon simple request from mesdessous.fr.

Personal Data

mesdessous.fr undertakes not to disclose to third parties the personal information you communicate to us. These are confidential. They will only be used by our internal services for the processing of your order and to strengthen and personalize the communication and the product offer reserved for mesdessous.fr customers. This article cannot prevent the assignment or transfer of activities to a third party.

For the purposes of the service, mesdessous.fr reserves the right to collect personal data relating to site users, in particular through "cookies".

In accordance with article L223-2 of the consumer code, the Customer is informed that they have the option to register for free on the telephone canvassing opposition list called BLOCTEL, available on the website www.bloctel.gouv.fr.

Bloctel is the telephone canvassing opposition list on which any consumer can register for free in order not to be canvassed by phone by a professional with whom they have no current contractual relationship, in accordance with law n° 2014-344 of March 17, 2014, relating to consumption.

The law specifies that it is forbidden for any professional, directly or through a third party acting on their behalf, to prospect a consumer registered on this list by phone, except in cases listed by law. In particular, you may still be called in the following cases:

• By professionals with whom you have an ongoing contract.
• For prospecting calls regarding the supply of newspapers, periodicals, or magazines.
• For reasons that do not relate to the sale of goods or services such as:
  • Calls from a public service
  • Calls from research and polling institutes
  • Calls from non-profit associations
• If you have freely and unequivocally provided your number to be called back.

The Legal Right of Withdrawal

The consumer has a withdrawal period allowing them to cancel their purchase without having to justify reasons or pay penalties within 14 calendar days from delivery, in application of the provisions of the European directive 2011/83/EU and following of the Consumer Code. The consumer must notify the company ESPRIT GRENADINE of their intention to return items within the framework of exercising their right of withdrawal by means of an unambiguous statement.

Consumer Dispute Mediation Mechanism

In accordance with articles of the consumer code L611-1 and following and R612-1 and following, it is provided that for any dispute of a contractual nature relating to the execution of the sales contract and/or the provision of services that could not be resolved within the framework of a complaint previously filed with our customer service, the Consumer may resort to mediation free of charge.
